New Mexico imposes a liquor excise tax on wholesalers who sell alcoholic beverages. The rate of tax varies according to the type and amount of alcoholic beverage sold as detailed below:
- spirituous liquors – $1.60 per liter
- spirituous liquors produced by a craft distiller – For products up to 10 percent alcohol by volume, $.08 per liter up to 250,000 liters sold; $.28 per liter for amounts between 250,00 and 500,000.
For products over 10 percent alcohol by volume, $.32 per liter up to 175,000 liters sold; $.65 per liter for amounts between 175,000 and 375,000 liters.
- beer – $.41 per gallon;
- beer manufactured or produced by a microbrewer – $.08 per gallon for the first 30,000 barrels sold; $.28 per gallon for amounts between 30,001 and 59,999 barrels; $.41 per gallon for 60,000 barrels or more.
- wine – $.45 per liter;
- fortified wine – $1.50 per liter;
- wine manufactured or produced by a small winegrower – $.10 per liter on the first 80,000 liters sold and $.20 per liter on liters sold over 80,000 but less than 950,000, and $.30 per liter on each liter sold over nine hundred fifty thousand liters but not over one million five hundred thousand liters;
- The volume of wine transferred from one winegrower to another winegrower for processing, bottling or storage and subsequent return to the transferor shall be excluded pursuant to Section 7-17-6 NMSA 1978 from the taxable volume of wine of the transferee. Wine transferred from an initial winegrower to a second winegrower remains a tax liability of the transferor, provided that if the wine is transferred to the transferee for the transferee’s use or for resale, the transferee then assumes the liability for the tax due pursuant to this section.
- A transfer of wine from a winegrower to a wholesaler for distribution of the wine transfers the liability for payment of the liquor excise tax to the wholesaler upon the sale of the wine by the wholesaler.
- cider –$.41 per gallon
- cider produced by a small winegrower, $.08 per gallon on the first 30,000 barrels sold; $.28 for per gallon from 30,001-59,999 000 barrels sold; $.41 per gallon for anything over 60,000 barrels sold.
The liquor excise tax is due by the twenty-fifth of the month following the taxable event. It is reported on form RPD-41129, Liquor Excise Tax Return.
